Privacy Policy

MLS-Images, Inc. ("we", "us", "our") operates the MLS Delivery service at https://mls-delivery.com (the "Service"). This Privacy Policy explains what personal information we collect, how we use it, who we share it with, and the rights you have with respect to that information.

Information we collect

When you create an account, use the Service, or communicate with us, we collect:

• Account information: your name, email address, mobile phone number, hashed password, and company name.
• Billing information: subscription plan, invoice history, and billing email. Payment card details are collected and stored by our payment processor Stripe — we never see or store the full card number.
• Content you upload: photographs, videos, and project metadata you upload to the Service to be delivered to your clients.
• Usage data: IP address, browser user agent, pages visited, and timestamps of significant events (login, upload, delivery, opt-in / opt-out of SMS), used to secure and operate the Service.

How we use SMS phone numbers

If you provide a mobile phone number and check the SMS-consent box during signup, we use that number solely to send you transactional SMS messages related to your account and use of the Service: booking confirmations, "photos are ready" delivery notifications, appointment reminders, and one-time account security codes (e.g. password reset).

Mobile phone numbers and SMS consent are NOT sold, rented, leased, or otherwise shared with any third party for marketing or promotional purposes. This information is used solely for the transactional communications described above.

Our SMS delivery is powered by Telnyx, an FCC-licensed common carrier, which acts as our messaging service provider under a data processing agreement. Telnyx receives your phone number and the message body solely for the purpose of delivering it to your carrier. Consent is timestamped and stored against your user record; opt-outs (STOP replies) are honored at the carrier level and mirrored in our systems immediately.

You may opt out of SMS at any time by replying STOP to any message. Message and data rates may apply; message frequency varies based on your account activity.

How we use other information

We use the information we collect to:

• Create and secure your account, and let you sign in.
• Deliver the Service you subscribed to (host and transmit your Content, show it to your clients, etc.).
• Process payments, send receipts, and manage billing (via Stripe).
• Send transactional email (password reset, receipts, delivery notifications) via Postmark.
• Send transactional SMS (see above), if you consented.
• Detect, prevent, and investigate abuse, fraud, or security incidents.
• Comply with applicable law and legal process.

Who we share information with

We share personal information only with the subprocessors listed below, strictly to the extent needed for them to provide their portion of the Service to us. We do not sell, rent, lease, trade, or share personal information with any third party for their own marketing.

• Stripe, Inc. — payment processing and subscription billing. Governed by stripe.com/privacy.
• Postmark (ActiveCampaign) — transactional email delivery. Governed by postmarkapp.com/privacy-policy.
• Telnyx LLC — transactional SMS delivery. Governed by telnyx.com/legal-center/privacy-policy.
• GoDaddy — hosting provider for the Service. Governed by godaddy.com/legal/agreements/privacy-policy.

We may also disclose information to comply with a subpoena, court order, lawful government request, or to protect the rights, property, or safety of us, our users, or others.

Data retention

We retain account and billing records for as long as your account is active and for a reasonable period thereafter to comply with legal and tax obligations. You may request deletion of your account and associated personal data by emailing support@mls-delivery.com; we will honor the request within 30 days, subject to any records we are legally required to retain.

Your rights

You have the right to:

• Access, correct, or delete the personal information we hold about you.
• Opt out of SMS at any time by replying STOP.
• Withdraw consent to marketing (we don't send marketing, so this is effectively opt-out from any future marketing programs we may create).
• Request a copy of your data in a portable format.
• Lodge a complaint with a supervisory authority if you believe your privacy rights have been violated.

Security

We protect personal information with industry-standard measures including TLS transport encryption, bcrypt password hashing, per-request signed webhook verification, and least-privilege access controls. No system is perfectly secure, but we work continuously to keep yours safe.

Children

The Service is not directed to children under 13, and we do not knowingly collect personal information from anyone under 13. If we learn we have collected such information, we will delete it promptly.

Changes to this Privacy Policy

We may update this Privacy Policy from time to time. Material changes will be announced by email to the address on file for your account and by a notice posted in the Service. Continued use of the Service after the effective date of a change constitutes acceptance of the updated Privacy Policy.
